UNCTAD finalised a study on IP and Competition Law for Costa Rica

UNCTAD and the National Competition Authority of Costa Rica (COPROCOM) have finalised a study and proposal on a regulation for compulsory licences due to anticompetitive practices, to be applied in Costa Rica.
 
The study considered the legal framework of Costa Rica on Competition and on Property Rights, and was aimed at providing a draft for a regulation that follows international best practices in the subject of compulsory licences. The study was conducted by international consultant Gustavo Valbuena, former head of the competition authority of Colombia and a current member of the Advisory Group of Experts of the Compal programme at UNCTAD. The expected impact of this product is that the Competition Authority of Costa Rica will have this resource to play an active role in the implementation of the regulation and a useful guide on how to enforce it, as a potential remedy for anticompetitive practices related to the use of patents.
